China’s Cyberspace Administration has introduced draft rules to regulate facial recognition technology’s security management due to concerns about its overuse. The regulator stipulates that facial data processing must have a specific purpose, necessity, and strong protective measures. Consent from individuals is required for technology use, and non-biometric options are favored when equally effective. Chinese courts have previously fined companies for excessive facial recognition use. The new rules prohibit image-capturing devices in privacy-sensitive areas and mandate public safety purposes for installations, coupled with prominent warning signs. These rules align with China’s broader data regulation efforts and the introduction of its first privacy law in 2021.
